Liberty Mutual Sandy ADR Program
IMPORTANT NOTICE TO LIBERTY MUTUAL POLICYHOLDERS
Damage to your home, personal property or business can be an emotional and overwhelming experience. Liberty Mutual Insurance, including all its subsidiaries such as Safeco Insurance, Ohio Casualty Insurance Company, Peerless Insurance Company and other companies, is committed to settling your claim as expeditiously as possible so you can get back to the business of living your life.
Liberty Mutual Insurance has been striving to resolve all Sandy-related claims quickly and fairly. We know you have worked with your designated adjuster to submit claims through our normal claims-handling process. Most claims have been processed successfully in this manner.
We recognize, however, that due to the complexity and the number of issues presented by the damage caused by Sandy, some homeowner, commercial, and other claims may not be fully resolved through the normal claims adjustment process. To assist in the resolution of these claims, Liberty Mutual Insurance has created a three-phase voluntary Alternative Dispute Resolution (ADR) Program with Kenneth R. Feinberg, former Administrator of the Federal September 11th Victim Compensation Fund and the Claims Administrator for the BP Gulf Coast Claims Facility. Liberty Mutual Insurance has also retained Mr. Feinberg to serve as the independent Program Administrator.
This three-phase program is completely voluntary and is available to our valued customers on eligible claims if the traditional adjustment process has reached an impasse. The program provides you with a cost effective option to resolve the impasse that is separate from traditional resolution options that may be available to you. All administrative costs associated with the program will be paid by Liberty Mutual Insurance. We will also pay for the mediators, the arbitrators and the facility at which the mediations and arbitrations take place. The only costs you will be responsible for are those associated with any attorney or experts you may retain or travel costs for you and any persons accompanying you.
